 Post subject: Death penalty- justified or murder?

I was reading up on this very common issue on another german-languaged forum. The common sense was widely split between "no never ever" and "yes, even for the slightest beat-up".
My personal feelings are: Yes, but only if you can be 100% sure that it is really the person who did the crime, capital crimes such as rape, murder and childpornography. Most people who are called "cured" tend to just do the crime again - with a rate of more than 30% just during the first 2 years.
Why would you let someone, who just ignores all the basic rules of our society, on expenses of the country and the people living there, keep in a prison with probably better conditions than he would have at home?
People raping children are no good for society and definitly deserve no second chance.
Do you guys agree with this or is there somebody here who thinks it isn't a justified thing?
FYI: Death penalty isn't allowed in germany since about 1950.

I don't really know how i feel on this. Ive thought on it many times but never been able to say fully yes or no. Imma kinda do this as i think about it in my head: 2 contradicting voices:

-How is it one man's right to determine whether another man should live or die? Surely only God (or whatever being in whatever religion you may believe) truly has that right.
-no matter who/what has that right, they obviously use that to draw a line somewhere and use that to decide yeah or nay
-but surely the line changes from person to person. Just because one person kills a man doesn't mean he's the same as another murderer. Everyone has sex but that doesnt mean you and i are the same

I could go on for a bit but it never ends, the arguing back and forth. but it isn't like math where 2+2 is obviously 4, it's something that some people, like myself, just can't get an answer for. maybe thatll change one day

I am for it ( we also dont have death penalty )

You can never be entirely sure if someone is really guilty. ( you can never be entirely sure of anything :) ).
Add a rule that judge who gives a death penalty must be the one who also executes it. Then they would thing more about it. But this is probably not possible :) .

Definitly. As you say, there is no way to be 100% sure of this stuff and the chances of getting the death penalty without haven't done it are minimal.
Also what is an "alternative" is the "arabic system":
For hard robbery you get your whrists broken, for murder your leg and eye cut off and for rape they will cut off your genetalia. This appear to be very cruel but why would you treat a rapist nice?

if you are a murderer, do you really think you should have a choice? Plus whats the most important is that the murder-ratio in those countries is usually (in a GPD compared way) extremly low.

If we act like that, then we would be just the same as the offender. And it is sure not nice to be in prison for several years. I think the hardest punishment is taking a man's freedom, not a death penalty. So in my opinion death penalty is not necessary and consequently not justified.

But what about like what Schlumpfi said, most people just commit a crime right after they're released?

We need to watch better after these persons and try to "help" them. And you can't kill people because of these 30% (as you might know statistics are very easy to manipulate. Winston Churchil: "the only statistics you can trust are those you falsified yourself".) most of these 30% are probably small-time criminals, trying to get money illegally. So are we allowed to risk to kill someone who might be better in the future? I agree that there are "crazy" people out there, but I believe it's enough to let them "rot" in prison.
